Article 13.1 Personnel and Evaluation Materials

Your union contract contains hundreds of provisions designed to protect your rights. Article 13.1 Personnel and Evaluation Materials defines you right to view, copy and know the location of personnel and supervisory files. Your Local 1000 contract guarantees:
 

  • Employees have one official personnel file and one supervisory work file.
  • Location of employees’ files will be identified by department head or designee.
  • Employees may request a copy of all personnel files including their supervisory file.
  • Employees may review official personnel and supervisory files during regular office hours. If the file is in a remote location, arrangements will be made to accommodate the employee.
  • Evaluation materials or materials related to conduct, attitude and service will not be included in an employee’s files without being signed and dated by the author.
  • Employees will review and be given a copy of all evaluation materials related to conduct before it is placed in the file.
  • Employees can insert his/her written response as supplementary material in their personnel and supervisory file.
  • Employees can request negative performance materials be purged after one year or once it is used in a written performance evaluation.

 
How to take Action
Contact your Local 1000 steward if you feel your rights have been violated and/or your supervisor will not approve reasonable time. Your steward will work with you, management and your contract to determine the best course of action, including whether or not to file a grievance.
