Unit 21 2008/2009 Bargaining Summary

Bargaining Unit 21 has negotiated new and improved language for its members at both the Unit Table and at the Master Table.  

Gains at the Bargaining Unit 21 Table
8.28.21 Educational Leave
Educational leave may now also be used to complete an employee’s individual Bachelor’s, Credential, Master’s or PhD program, regardless of whether or not it furthers the employee’s work assignment or the achievement of departmental goals.  An employer must now provide an employee with a reason for a denial of educational leave use within 15 days of request.  A denial can be appealed to Step 3, DPA.

10.9.21 Safety Equipment NEW
The State is committed to providing protective and safety equipment for the personal protection of its employees.  Denial of a request for safety equipment must be in writing.

10.11.21 Hazardous Materials NEW
The State must provide a Material Safety Data Sheet (MSDS) for each hazardous substance in use at the place of employment.

10.13.21 Access to Work Areas 24 Hours NEW

Employees in 24-hour facilities/institutions shall be provided keys upon request.  Departments may grant keys outside their normal work schedule subject to operational needs.

10.14.21 Personal Alarms  NEW
Departments must make available to all employees who have contact with inmates a personal alarm transmitter in areas equipped with an alarm.

10.18.21 Referral of Assault/Battery  NEW
The State must refer all cases involving a ward/inmate assault and/or battery on an employee to the appropriate prosecuting authority.

10.19 Assaultive Behavior NEW
The State will endeavor to provide training to all employees at risk of assault on how to diffuse potentially violent situations and verbal confrontations.

10.25.21 Infectious Disease Control
Employees must be provided training on infectious disease control. The State shall endeavor to notify potentially exposed employees when it becomes aware of an outbreak of infectious, contagious diseases/conditions at a worksite.
    
10.26 Precautions to Bloodborne Pathogens  NEW
CDCR, DMH, CDVA & DDS shall utilize the best guidelines identified for the housing, control and treatment of inmates, wards, clients and patients to ensure the protection of staff from exposure to bloodborne pathogens.   

11.9 Bilingual Differential Pay
Employees who do not receive a bilingual differential shall not be required to use bilingual skills.

11.17 Recruitment & Retention Differentials NEW
Upon DPA approval a department may provide a monthly recruitment and retention differential to employees.

11.64.21 Professional Development Incentive
Continues a $300 one-time professional development incentive for completing at least 6 hours of educational study to enhance professional capabilities.

12.13.21 Business Equipment, Materials & Supplies
Adds that it is the State’s intent to provide business equipment, materials and supplies to enable employees to perform assigned duties and responsibilities.

12.14.21 Professional Dues
Adds that the State shall provide online access to professional journals or publications available through the State Library as department technology becomes accessible.

12.15.21 Reimbursement of Fees
Continues reimbursement up to $200/year for one job related credential and/or license.

12.26. 21 Travel to AM Meetings NEW
Employees required to attend meetings before 8:00 AM at a distance of more than 90 miles from their worksite can request their manager to approve prior night’s lodging at departmental expense.

12.27.21  Timely Reimbursement Travel Expenses NEW
Within 30 days of ratification the California Teachers Credentialing will meet with the Union to discuss streamlining and expediting the reimbursement process.

13.2 Career Development Personal Performance NEW
Requires that meetings between employees and management regarding unsatisfactory performance or work-related problems should be held in private.

13.6.21 Performance Appraisal of Permanent Employees
Adds that, in the absence of any current annual performance appraisal or performance evaluation to the contrary, the employee’s performance shall be deemed to be satisfactory.

14.4.21 Duty Statements, Post Orders, & Work Instructions
Adds that Departments must provide employees with a current duty statement within 15 calendar days of request.  Duty statements shall also be provided when a class is established or revised.

14.5 Automation & New Technology  NEW
The State has a duty to notify and meet with the Union prior to implementation of automation or technological changes resulting in significant impact to employees.

14.7 Automation of Duties Normally Performed by BU Employees NEW
The State must notify and meet with the Union before assigning duties normally performed by Unit 21 employees to any employee, group, individual, organization or business enterprise if the assignment results in displacement of Unit 21 employees.

14.22.21 Joint Union Management Committee (Community Colleges Classes) NEW
The Community College Chancellor’s Office and the Union shall meet to review and make suggestions about whether the Community College Administration class series needs revision.

14.24.21  JLMC Archivist Classes  NEW
Within 30 days of ratification, the Secretary of State shall meet with the Union to determine whether or not the Archivist class series should be updated.

17.11.21 Education Leave: Conversion at Retirement
Continues employees’ ability to convert education leave at retirement into retirement service credit.

19.30.21 Community Colleges Program Assistant I – FLSA Exempt NEW
The State agrees to convert the CCPA I class from WWG 2 to WWG E - FLSA Exempt.

21.16.21 Professional Responsibility
Unit 21 employees’ have the right to exercise their professional judgment in their work and scheduling of work hours.  Adds “locations” of work. 

SL 1.21 Private Post Secondary Agreement NEW
Incorporates into the Contract the agreement reached between the Union and DCA on June 22, 2007 concerning employees impacted by the closing of the Bureau of Private Postsecondary and Vocational Education.

Bargaining Unit 21 also made significant gains by being newly included in Master Table agreements
2.11 Bargaining Unit Negotiating Committee Member Time Off NEW
Designated BUNC members shall suffer no loss in compensation when they attend bargaining unit negotiations with management.

9.11 Enhanced Industrial Disability Leave (EIDL) NEW
Employees in CDCR, DDS, DMH, CDVA or Special Schools who lose the ability to work for more than 22 workdays due to an injury caused during an assault by a patient/client, inmate/ward, or parolee may be eligible for augmented IDL benefits.
 
9.14 Temporarily Disabled Employees NEW
Adds procedures the state must follow regarding temporarily disabled employees.

10.4 Injury & Illness Prevention Program NEW
Requires departments to establish, implement and maintain IIPPs.

10.6  Emergency Evacuation Procedures NEW
Requires departments to establish, implement, and maintain emergency evacuation procedures.

10.21 Workplace Violence Prevention NEW
Requires departments to maintain and distribute a Workplace Violence Prevention Program.

10.27  Remodeling/Renovation & Repairs  NEW
Requires the State to notify the Union when a State-owned or managed building is remodeled or renovated.  Also requires advance notice from Lessors of non-State managed buildings.
 
10.28  Pest Control NEW
Requires departments to notify the Union in advance when utilizing a pest control chemical.
 
10.29 Smoking Cessation NEW
Requires the State to provide smoking cessation programs.

15.3 Hardship Transfer  NEW

Provides guidelines for providing appropriate hardship transfers to assist employees experiencing a personal or family hardship.
 
SL 3 Domestic Partners  NEW
Adds provision for certifying a domestic partner per Family Code 297 with the Secretary of State.

Addendum 1 Time Off for Victims of Domestic Violence  NEW
Addresses the ability of employees experiencing domestic violence to take time off to seek appropriate aid.
