In every legislative cycle, a handful of bills are introduced that would directly affect public employee pensions. This year is no different. Board of Equalization

BOE Headquarters Building

The BOE has outgrown its current headquarters building. AB 1143 (Dickinson), allows DGS to begin searching for a permanent, consolidated location for BOE’s headquarters operation.

AB 1143 was heard on April 12, 2011 and was voted out of the Assembly Business and Professions Committee on a bipartisan 9-0 vote. The bill is currently in the Assembly Appropriations Committee.

Classifications

Local 1000 is sponsoring AB 1395 (Swanson) which allows state employees in classifications specific to one department or in limited departments to be placed on general reemployment lists in comparable statewide classifications. The bill also requires all departments to place vacancies and examinations on the State Personnel Board’s Vacancy Search (VPOS) website.

AB 1395 was heard on April 13, 2011 and was passed on consent in the Assembly Public Employees, Retirement, and Social Security Committee.

Continuous Appropriations

Due to multiple court decisions, if a budget is not in place by June 15th, state employees are subject to federal minimum wage required under the Fair Labor Standards Act, which for most employees is a paltry $7.25. Local 1000 finds this unacceptable and is supporting SB 270 that would ensure that state employees receive their full salary in the event a budget is not passed by June 15th, by continuously appropriating employee payroll.

SB 270 was heard on March 22, 2011 and was voted out of the Senate PERS Committee.  The bill is currently in the Senate Appropriations Suspense File.

Employment Development Department

EDD UI One Stop Career Center

AB 391 (Pan) is a bill that allows the Employment Development Department to adjust its existing resources to give out-of-work Californians the option of in-person Unemployment Insurance assistance in one-stop career centers. This measure would amend the Unemployment Insurance Code to require California to have available walk-in UI services, provided by current UI-funded and fully-trained workers in regional one-stop centers.

AB 391 was heard on April 13, 2011 and voted out of the Assembly Labor and Employment Committee by a bipartisan vote of 5 – 1. The bill is now in the Assembly Appropriations Committee.

Public Employee Rights

Local 1000 is a co-sponsor of AB 920 (Portantino), titled the Public Employee Bill of Rights. This bill requires that any notice of an adverse action and investigation must be completed within one year from the time discipline issues first arose.

AB 920 was heard on April 7, 2011 and passed the Assembly Public Employees, Retirement, and Social Security Committee by a vote of 4 – 2. The bill is currently in the Assembly Appropriations Suspense File.

State Compensation Insurance Fund (SCIF)

AB 1263 (Williams) is a bill that prevents SCIF board members and officers from lobbying the board for a period of two years after leaving the Fund. 

Additionally, this bill requires that all consulting contracts with former board members or officers be approved by the board.

AB 1263 was heard on April 13, 2011 and voted out of the Assembly Insurance Committee by a bipartisan vote of 12 – 0. The bill is now on the Assembly Third Reading File.

Transparency

AB 172 (Eng), a bill similar to AB 1899 and would require state agencies, the Department of General Services, and the office of the State Chief Information Officer to post audits and contracts to the state’s Reporting Transparency in Government Internet Web site.

AB 740 (Blumenfield), a bill similar to AB 2494 would requires a state agency to immediately discontinue a contract disapproved by action of the State Personnel Board and would prohibit the state agency from circumventing or disregarding the board’s action by entering another contract for the same or similar services or to continue the services that were the subject of the contract that was disapproved.

AB 172 and AB 740 were heard in the Assembly Business and Professions Committee on April 5, 2011 and were voted out of the Assembly Business and Professions Committee by a vote of 6 – 2 and 8 – 0. Both bills are currently in the Assembly Appropriations Committee awaiting a hearing date.

In the Senate, Local 1000 is co-sponsor of SB 252 which requires agencies to disclose the cost and duration of state contracts, making contracts of $100,000 or more publically accessible. SB 252 was heard on April 12, 2011, and passed out of the Senate Governmental Organization Committee by a vote of 7 – 4. The bill is currently in the Senate Judiciary Commission.

Use Tax

Loopholes in California’s Revenue and Taxation code allow out-of-state online retailers to get away without paying millions in use taxes. Local 1000 is strongly supporting AB 153 (Skinner) and AB 155 (Calderon) which will require out-of-state businesses to collect and remit sales tax to the state.

Worker Safety

Member safety is the top priority for Local 1000. This year we are strongly supporting multiply employee safety bills. Among those bills, we are sponsoring AB 933 (Allen), which provides disability coverage to all employees who work at facilities were more than 50% of the residents are remanded by the criminal court.

AB 933 will be heard on May 4, 2011, in the Assembly Public Employees, Retirement, and Social Security Committee.
