CDCR/CCHCS N95 Masking Requirements Violate Uniform Application Provision

On December 2, 2021 SEIU Local 1000 served a statewide grievance on CDCR/CCHCS for ignoring contract requirements for uniform application of N95 masking requirements.  CDCR/CCHCS institutions are imposing different masking requirements for employees in similar areas based solely on vaccination status. Even though employees may work in similar areas and comparable duties, CDCR/CCHCS has arbitrarily distinguished employee not based on job duties or frequency of interaction with others, but solely on their vaccination status.

On November 8, 2021, SEIU Local 1000 first notified CDCR/CCHCS labor relations that its mandate that all employees wear N95 masks as a condition of employment violated standards dictated by Cal-OSHA. This statewide grievance escalates this challenge for all affected workers.
