After additional bargaining sessions, Bargaining Unit 20 (BU 20) bargaining team has continued presenting proposals while also receiving Tentative Agreements (TAs) from the State that preserve existing contract protections and rights for members. 

Bargaining Activity This Week

This week, the bargaining team presented several proposals, passed rollover language, and reached multiple tentative agreements (TAs).

Proposals: The following proposals were formally presented to the State for consideration. These items have not yet been agreed to and are still awaiting a response from the State. 

  • 19.13.20 – Overtime Mandatory Scheduling – Excluding CDCR LVNs and CNAs 
  • 19.14.20 – Overtime Mandatory Scheduling – CDCR and CCHCS LVNs (Unit 20)

 The bargaining team continues fighting to reduce and ultimately eliminate Mandatory Overtime (MOT). Reducing excessive mandatory overtime remains one of the union’s major bargaining priorities. 

The bargaining team is also working to combine existing LVNs’ and CNAs’ overtime language into a single article in the new MOU while maintaining protections for all represented classifications.

  • 19.21.20 – Overtime Voluntary Scheduling – Excluding CDCR/CCHCS LVNs and CNAs 
  • 19.22.20 – Overtime Voluntary Scheduling – CDCR and CCHCS LVNs

 Proposals related to voluntary overtime scheduling for CDCR and CCHCS LVNs and CNAs were also presented this week as the team continues working to improve scheduling processes and overtime practices.

  • 8.28.20 – Continuing Education Units (CEU) 

The bargaining team presented language changes related to continuing education leave in order to strengthen members’ ability to use their authorized CEU hours for meaningful professional development opportunities.

The proposal removes language that allowed mandatory in-service trainings to count toward continuing education leave, helping ensure employees can use CEU time for training that genuinely supports skill development and licensure requirements.

  • 11.1.20 – Special Salary Adjustments (SSA)

The bargaining team continues advocating for salary improvements and recruitment and retention efforts for BU 20 classifications. Respiratory Care Practitioners presented information to the state regarding their classifications, responsibilities, and the need for improved compensation and staffing support.

  • 11.2.20 – State Special Schools Recruitment and Retention Differentials

The bargaining team proposed moving the State Special Schools Recruitment & Retention differential from a side letter directly into the MOU contract language. This differential shall be paid for the ten (10) month school year only and shall be considered retirement compensation. 

This proposal impacts classifications, including:

  • Readers for the Blind
  • Transportation Coordinators
  • Support Bus Drivers
  • Support Services Assistants/Interpreters
  • Teaching Assistants for the School for the Blind and the School for the Deaf
  • Night Attendance
  • Counselors for the School for the Blind and the School for the Deaf
  • Counselors at the Orientation Center for the Blind (Albany)

  • 8.26.20 – CDCR/CCHCS Vacation Scheduling – LVN, CNA, and MAs

The bargaining team also proposed updates related to vacation scheduling provisions for CDCR and CCHCS employees.

Tentative Agreements (TAs): The bargaining team reached several rollover tentative agreements this week that maintain important existing contract protections and provisions.

  • 7.2.20 – Holidays – State Special Schools (Residential Counselors & Night Attendants)
  • 8.23.20 – Department of Veterans Affairs Vacation Scheduling
  • 8.24.20  Department of Developmental Services/LVN Vacation Scheduling
  • 8.30.20  Family Crisis Leave Bank, State Special Schools
  • 11.67.20 – Alternate Range Criteria Counselor at State Special Schools
  • 19.31.20 – Split Shift
  • 21.22.20  Licensure / Certification

Additional Article Sections & Side Letters: The bargaining team also passed existing contract language related to licensure/certification and Appendix P, Side Letter 16.20, while continuing discussions on additional proposals being held for master table negotiations.
