CDTFA’s return to the office / telework policy

On April 15, 2022, SEIU Local 1000 and the California Department of Tax and Fee Administration (CDTFA) Labor Relations met regarding CDTFA’s return to the office / telework policy. From what we understand, CDTFA statewide started returning employees to the office on a 1 day per week basis for all employees permanently teleworking due to the COVID-19 emergency. This does not include those employees that were full-time teleworking prior to COVID-19. As well, we clarified that the field is considered “the office” for field staff. So doing a day of work in the field satisfies the 1 day “in office.”

In addition, we confirmed that the overall goal is to be less strict and more flexible. Anyone who, prior to COVID, was only coming in to the office rarely on an “as-needed” basis should return to that. As well, we confirmed that “flexibility” means reasonable flexibility, with supervisor approval, to change/swap a “remote” day for an “in office” day.

We also raised that we were aware, and notified CDTFA, that certain divisions at CDTFA Headquarters were returning employees early, despite the 30 day requirement and the date in the notice to SEIU Local 1000.  Although SEIU Local 1000 issued a Cease and Desist letter, CDTFA moved forward anyway. We are reviewing all options and exploring all legal avenues available regarding CDTFA’s returning employees earlier than the date provided in the notice. Please expect another update coming soon about this matter.
